If Someone Has Little New Wealth—Can He Bequeath from It?
Hadith 32992
٣٢٩٩٢ - حدثنا. . . (١) ابن جريج عن ليث عن طاوس عن ابن عباس (قال: إذا ترك الميت سبعمائة درهم فلا يوصي) (٢) (٣).
It is narrated from Tawus that Hazrat Ibn Abbas (may Allah be pleased with them) said: When a dying person is leaving behind seven hundred dirhams, he should not make a will.
Hadith 32993
٣٢٩٩٣ - حدثنا زيد بن حباب عن (همام) (١) عن قتادة ﴿إِنْ تَرَكَ خَيْرًا الْوَصِيَّةُ﴾ [البقرة: ١٨٠]، قال: خير المال، كان يقال: ألف درهم فصاعدًا.
It is narrated from Hammam that Hazrat Qatadah, in explanation of the Divine command {إنْ تَرَکَ خَیْرًا الْوَصِیَّۃُ }, said: At that time, it was commonly known among the people that the best wealth is one thousand dirhams.
Hadith 32994
٣٢٩٩٤ - حدثنا أبو خالد عن هشام عن أبيه أن عليًا دخل على رجل من بني هاشم يعوده فأراد أن يوصي فنهاه، وقال إن اللَّه يقول: ﴿إِنْ تَرَكَ خَيْرًا﴾ وإنك لم تدع مالًا فدعه لعيالك (١).
It is narrated from Urwah that Hazrat Ali (may Allah be pleased with him) came to a man from Banu Hashim to visit him during his illness. When the man began to make a will, Hazrat Ali forbade him and said: Allah Almighty has said, "If (the deceased) leaves behind wealth," and you are not leaving behind any wealth, so leave whatever there is for your children!
Hadith 32995
٣٢٩٩٥ - حدثنا أبو معاوية عن محمد بن شريك عن ابن أبي (مليكة) (١) عن عائشة قال: قال لها رجل: إني أريد أن أوصي، قالت: كم مالك؟ قال: ثلاثة آلاف، قالت: فكم عيالك؟ قال: أربعة، (قالت) (٢): فإن اللَّه يقول: ﴿إِنْ تَرَكَ خَيْرًا﴾ وإنه شيء يسير فدعه لعيالك فإنه أفضل (٣).
Ibn Abi Mulaykah narrates that a man said to Hazrat Aisha (may Allah be pleased with her), "I wish to make a will." She asked, "How much wealth do you have?" He replied, "Three thousand." She asked, "How many family members do you have?" He said, "Four." She said, "Allah Almighty has mentioned this condition: 'If he leaves wealth,' and you have very little wealth. Leave it for your children; that is better."
