Bequest of the Insane Person
Hadith 32874
٣٢٨٧٤ - حدثنا الضحاك (بن مخلد عن ابن جريج) (١) قال: قلت العطاء: الأحمق والموسوس) (٢) أتجوز وصيتهما إن أصابا الحق (وهما مغلوبان) (٣) على عقولهما؟ قال: ما (أحسب لهما وصية) (٤).
Ibn Jurayj says that I asked Ata: If a foolish and confused person makes a proper will while their mind is overpowered, will their will be executed? He replied: I do not consider his will to be valid.
Hadith 32875
٣٢٨٧٥ - حدثنا (ابن مهدي) (١) عن حماد بن سلمة عن إياس بن معاوية في وصية (المجنون قال: إذا أصاب الحق جاز) (٢).
It is narrated from Hammad bin Salamah that Hazrat Iyas bin Mu'awiyah said regarding the will of a madman that if the will is correct according to the rules, it will be enforced.
Hadith 32876
٣٢٨٧٦ - حدثنا (حدثنا ابن) (١) مهدي عن همام عن قتادة عن حميد بن ⦗١٩٨⦘ عبد (الرحمن قال: لا تجوز وصية ولا طلاق إلا في (عقل)) (٢) (٣)] (٤).
It is narrated from Qatadah that Humaid bin Abdur Rahman said: Will and divorce are not valid without intellect.
