One Who Becomes Ill and Bequeaths the Freedom of His Slaves Without Specifying the Illness
Hadith 32862
٣٢٨٦٢ - حدثنا عبد الأعلى عن معمر عن ابن طاوس أن رجلًا من أهل اليمن أوصى فقال: فلان حر، وفلان حر -ولم يسم- إن مت في مرضي هذا، فبرأ الرجل فخاصمه (مملوكاه إلى) (١) قاضي أهل الجند فشاور في ذلك طاوسًا، فقال طاوس: هم عبيد، إنما كانت نيته إن حدث به حدث.
It is narrated from Ibn Tawoos that a resident of Yemen made a will and said: Such-and-such slave is free, and such-and-such slave is free, and he did not say: "If I die from this illness." So that man recovered, and his slaves filed a claim before the judge of Janad. The judge consulted Hazrat Tawoos, and Tawoos said: They are slaves, because the intention of that man was only: "If I die."
