Musannaf Ibn Abi Shaybah

Muhammad narrates that Ubaidullah bin Abdullah bin Muammar said regarding a will: Whoever mentions a person's name while making a will, we will give the wealth to the person whose name was mentioned in the will. And whoever makes a will in such a way that it is stated, "Let it be spent wherever Allah commands," then we will give the wealth to his relatives.

Mu'tamir narrates from his father, who narrates from Hasan regarding the man who makes a bequest for distant relatives and leaves out the close relatives. He said that the bequeathed wealth should be divided into three parts: two-thirds for the close relatives and one-third for the distant relatives. And Muhammad bin Ka'b used to say that this is wealth given by Allah; He may spend it wherever He wills.

Humaid narrates from Muhammad bin Sirin that he said: Spend the bequeathed wealth in the place where the testator has instructed it to be spent.

It is narrated from Hammam that Qatadah was asked about a man who makes a bequest for those with whom he has no relation. He replied that Salim, Sulaiman bin Yasar, and Ata used to say that the wealth should be given to the one for whom he made the bequest.

Ibn Jurayj narrates from Ata who says: I asked Ata about a man who made a bequest for the mujahideen and the needy, but among his relatives there are many people in need. He replied: His bequest will be carried out exactly where he made it.

Ibn Jurayj narrates that Ibn Abi Mulaykah said that the one making the will has instructed the executors of the will; if they oppose this instruction, even then it will be implemented, but their action will be wrong, and Hazrat Ata used to say that relatives have more right.

Jabir narrates from Hazrat Amir, he said that a man has authority over one third of his wealth; if he wishes, he may throw it into the sea.
