One Who Has Several Houses and Bequeaths a Third—Can They Be Combined or Not?
Hadith 32792
٣٢٧٩٢ - (١) حدثنا حماد بن خالد عن عبد اللَّه بن جعفر عن سعد بن إبراهيم قال: سألت القاسم عن رجل كانت له مساكن فأوصى بثلث كل مسكن له، قال: (يخرج) (٢) حتى يكون في مسكن واحد.
Sa'd bin Ibrahim narrates that I asked Hazrat Qasim about a man who had several houses, then he made a bequest of one-third of each house. He replied: The entire portion should be taken out from one house.
Hadith 32793
٣٢٧٩٣ - حدثنا يعلى عن عبد الملك عن عطاء في رجل أوصى بثلث ماله وأشياء سوى ذلك، وترك دارًا (تكون) (١) ثلثها أيعطاها الوصى له بالثلث، قال: لا، ولكن يعطى بالحصة من المال والدار.
It is narrated from Hazrat Ata regarding the man who made a will for one third of his wealth and some other items, and left behind a house which constituted one third of his wealth. He was asked whether the person for whom the will was made could be given that house as the one third share. He replied: No, rather he should be given a share from both the wealth and the house.
