Hadith 32754
٣٢٧٥٤ - حدثنا جرير عن منصور عن إبراهيم قال: إذا أوصى الرجل (بوصية) (١) لوارث، فأجاز الورثة قبل أن يموت، (ثم رجع) (٢) الورثة بعد موته، فهم على رأس أمرهم، وإذا كان (لغير وارث زيادة على الثلث فمثل ذلك، وإذا كانت) (٣) لغير وارث ما بينه وبين الثلث فإنها جائزة.
Ibrahim says that if a person makes a will in favor of an heir and before his death his heirs give their consent, then after his death if they change their decision, they have the right to do so. And if a will is made for a non-heir for more than one-third of the wealth, the same rule applies. And if a will is made for a non-heir for less than one-third, then it becomes effective.
Hadith 32755
٣٢٧٥٥ - حدثنا علي بن مسهر عن داود عن الشعبي عن شريح قال: إذا استأذن الرجل ورثته في الوصية فأوصى بأكثر من الثلث فطيّبوا له، فإذا نفضوا أيديهم (من قبره) (١) فهم على رأس أمرهم، (إن شاؤا أجازوا) (٢)، وأن شاؤا لم يجيزوا.
Hazrat Shurayh states that when a person seeks permission from his heirs and makes a bequest of more than one-third of his wealth, and the heirs also express their consent, then after the death of that person, the heirs have the authority to either enforce or not enforce that bequest anew.
Hadith 32756
٣٢٧٥٦ - حدثنا ابن عيينة عن صالح بن مسلم عن الشعبي قال: سألته فقال: هم على رأس أمرهم.
Salih bin Muslim narrates that I asked Sha'bi about such a will, so he said: They will be given the right to choose anew.
Hadith 32757
٣٢٧٥٧ - (١) حدثنا محمد بن بكر عن ابن جريج عن (ابن) (٢) طاوس عن أبيه قال: يرجعون إن شاؤا.
Ibn Tawus narrates from his father: Such heirs, if they wish, can retract their decision.
Hadith 32758
٣٢٧٥٨ - حدثنا عبد الأعلى عن يونس عن الحسن في رجل أوصى بأكثر من الثلث برضا (من) (١) الورثة، فلما مات أنكروا ذلك، قال: هو جائز عليهم.
Yunus Hasan (may Allah have mercy on him) narrates that he was asked about a man who made a bequest of more than one-third of his wealth with the consent of his heirs, but when he died, the heirs refused to give more than one-third. He replied: This is permissible for them.
Hadith 32759
٣٢٧٥٩ - حدثنا محمد بن بكر عن ابن جريج قال: كان عطاء يقول: جائز، قد أذنوا.
Ibn Jurayj states that Ata used to say that this matter is permissible for the heirs; the scholars have permitted it.
Hadith 32760
٣٢٧٦٠ - حدثنا غندر عن شعبة عن حماد أنه قال في الرجل يوصي بأكثر من الثلث: يجيزه الورثة ثم يرجعون فيه، قال: ليس لهم أن يرجعوا.
Shu’bah narrates from Hammad that regarding the person who makes a bequest of more than one-third, if the heirs permit it and then later retract, he said: They do not have the right to retract in this manner, and he ruled that if they wish, they can retract.
Hadith 32762
٣٢٧٦٢ - حدثنا ابن أبي (غنية) (١) عن أبيه عن الحكم قال: إذا أوصى الرجل فزاد على الثلث فاستأذن ابنه في حياته فاذن له، فإذا مات فعاد إلى ابنه، إن شاء أجازه وإن شاء رده.
Hazrat Hakam states that when a person makes a will for more than one-third of his wealth and, during his lifetime, seeks permission from his son and the son grants permission, even then, after the person's death, the son will have the authority—if he wishes, he may enforce the will, and if he wishes, he may reject it.
Hadith 32763
٣٢٧٦٣ - حدثنا وكيع عن المسعودي عن أبي عون عن القاسم بن عبد الرحمن أن رجلًا استأذن ورثته في موضه في أن يوصي بأكثر من الثلث فأذنوا له، فلما مات رجعوا، فسئل ابن مسعود عن ذلك فقال: (ذلك) (١) لهم ذلك (التكره) (٢) لا يجوز (٣).
Qasim bin Abdur Rahman narrates that a man, during his terminal illness, sought permission from his heirs to bequeath more than one-third of his wealth. They granted him permission, but when the man died, they retracted their consent. Hazrat Ibn Mas'ud (may Allah be pleased with him) was asked about this matter, and he said: They have the right to do so, and it is not permissible to compel them against it.
Hadith 32764
٣٢٧٦٤ - (١) حدثنا وكيع قال: حدثنا سفيان عن منصور عن إبراهيم عن داود ابن أبي هند عن عامر.
Hazrat Shurayh says that if a person, during his terminal illness, makes a bequest of more than one-third of his wealth to a non-heir or an heir, and the heirs also permit it, then if that person dies, the heirs have the right to retract their permission.
Hadith 32766
٣٢٧٦٦ - حدثنا غندر عن شعبة عن يزيد بن خالد الدالاني قال: سمعت أبا عون محمد بن (عبيد اللَّه) (١) يحدث عن القاسم بن عبد الرحمن عن أبيه عن عبد اللَّه أنه قال في الرجل يوصي بأكثر من الثلث يجيزه الوارث ثم لا يجيزه بعد (موته) (٢)، قال: ذلك التكره لا (يجوز) (٣) (٤).
Abdur Rahman narrates from Hazrat Abdullah that regarding the person who makes a will for more than one-third of his wealth, and the heir also permits its execution, but after his death does not execute it, he said: It is not permissible to compel him.
