Regarding the Ruler Who Sees a Man Involved in a Punishable Act While Alone: Should Hudud Be Applied?
Hadith 30807
٣٠٨٠٧ - حدثنا أبو بكر قال: حدثنا شريك عن (عبد الكريم) (١) عن عكرمة قال: قال عمر لعبد الرحمن بن عوف: أرأيت لو كنت القاضي والوالي ثم أبصرت إنسانا على حد، أكنت مقيما عليه؟ قال: لا، حتى يشهد معي غيري، قال: أصبت ولو قلت غير (ذلك) (٢) لم (تجد) (٣) (٤).
Hazrat Ikrimah narrates that Hazrat Umar asked Hazrat Abdur Rahman bin Auf: What is your opinion, if you are a judge and ruler and you see someone involved in an act requiring a prescribed punishment (hadd), will you establish the hadd on him or not? He replied: No, not until someone else also testifies with me. Hazrat Umar said: You have spoken correctly, and if you had said anything else, you would not have been right.
Hadith 30808
٣٠٨٠٨ - حدثنا أبو بكر قال: حدثنا ابن مهدي عن سفيان قال: سمعت حمادا يقول: سمعنا أن الحاكم يجوز قوله فيما اعترف عنده إلا الحدود.
Hazrat Sufyan says that I heard Hazrat Hammad saying: Certainly, the statement of the ruler is valid in those matters which have been confessed before him, except for the hudood (prescribed punishments).
