Musannaf Ibn Abi Shaybah

Hazrat Jabir narrates that the Messenger of Allah (peace and blessings be upon him) said: The punishment of amputation will not be carried out on the one who commits treachery.

Hazrat Abu Zubair narrates that Hazrat Jabir said: The punishment of cutting (the hand) will not be carried out on the one who commits treachery.

Hazrat Sha'bi narrates that a man came to Hazrat Shurayh and said: "Indeed, this person has stolen from me." Hazrat Shurayh asked: "Who is this person?" He replied: "He is my servant." Hazrat Shurayh said: "That person cannot be considered a thief whom you have appointed as a trustee in your house."

Hazrat Ibn Jurayj states that Hazrat Ata said: The punishment of amputation will not be enforced in the case of betrayal.

Hazrat Abu Hurrah narrates that it is reported from Hasan Basri regarding a slave who was in the market with some people and stole some of their goods. He said: He is a betrayer, and the punishment of cutting (the hand) will not be carried out on him.
