Hadith 30432
٣٠٤٣٢ - حدثنا أبو بكر قال: حدثنا (هشيم) (١) عن إسماعيل بن سالم عن الحكم أنه قال: في رجل وطئ جارية من الفيء، قال: ليس عليه حد، له فيها نصيب.
Hazrat Ismail bin Salim narrates that it is reported from Hazrat Hakam regarding a man who had intercourse with a slave woman from the spoils of war. He said: The prescribed punishment (hadd) will not be carried out on him, as long as he also has a share in her.
Hadith 30433
٣٠٤٣٣ - حدثنا أبو بكر قال: حدثنا عبدة عن سعيد عن قتادة عن سعيد بن المسيب قال: ليس عليه حد إذا كان له فيها نصيب.
Hazrat Qatadah says that Hazrat Saeed bin Musayyib said: The hadd punishment will not be carried out on him as long as he also has a share in that war booty.
Hadith 30434
٣٠٤٣٤ - حدثنا أبو بكر قال: حدثنا وكيع عن موسى بن عبيدة عن (بكير) (١) ابن داود أن عليًا أقام على رجل وقع على جارية من الخمس الحد (٢).
Hazrat Bukair bin Dawood narrates that Hazrat Ali (may Allah be pleased with him) enforced the prescribed punishment on a person who had intercourse with a slave woman from the spoils of war's one-fifth share.
Hadith 30435
٣٠٤٣٥ - حدثنا أبو بكر قال: حدثنا يزيد بن هارون عن هشام عن الحسن قال: إذا كان له في الفيء شيء (عزر) (١)، و (يقوم) (٢) عليه، وكذلك في جارية بينه وبين (رجل) (٣).
Hazrat Hisham states that Hasan Basri said: When there is a share of someone in the spoils of war, then he will be punished as a disciplinary measure and the value will be obligatory upon him, and the same ruling applies to a slave girl who is jointly owned by him and another person.
