Diyah Is Obligatory Upon the Leaders of the Tribe
Hadith 29905
٢٩٩٠٥ - حدثنا أبو بكر قال: حدثنا وكيع عن سفيان عن جابر عن عامر قال: سأله ابن هبيرة عن العقل على رؤوس الرجال أو على (الأعطية) (١) قال: لا، بل على رؤوس الرجال.
Hazrat Jabir narrates that Hazrat Ibn Hubaira asked Hazrat Amir about the matter of blood money (diyat): Will the blood money be obligatory upon the leaders of the people or upon the common people as well? He replied: No, rather it is upon the leaders of the people.
Hadith 29906
٢٩٩٠٦ - حدثنا أبو بكر قال: حدثنا وكيع قال: سمعت سفيان يقول: (العقل) (١) والقسامة و (الشفعة) (٢) على رؤوس الرجال.
Hazrat Waki’ says that I heard Hazrat Sufyan saying: The blood money of Qasamah and the right of pre-emption (Shuf’ah) will be obligatory upon the chiefs of the people.
