Musannaf Ibn Abi Shaybah

Hazrat Muammar narrates that Hazrat Ziyad bin Muslim said: A man from India came to Aden with a guarantee of safety, but one of the Muslims killed him because of his brother. So a letter was written to Hazrat Umar bin Abdul Aziz regarding this matter, and he replied: Do not kill him; take blood money from him and send that blood money to the heirs of the murdered person. And by your order, he was imprisoned.

Hazrat Yusuf bin Yaqub narrates that a man from among the polytheists killed a Muslim man, then that person entered (the Muslim area) under protection, so the brother of the Muslim killed him. Thus, Hazrat Umar bin Abdul Aziz decided upon the payment of blood money against him: and he placed the burden of this blood money upon his wealth and imprisoned him, and the blood money was sent to the heirs of the slain who were present among the people at war.

Hasan Basri narrates that a polytheist man performed Hajj. When he returned after performing Hajj, he met a Muslim man who killed him. So the Noble Prophet (peace and blessings be upon him) ordered that person to pay blood money to his heirs.

Hazrat Abu Hurrah narrates that it is reported from Hasan Basri regarding those individuals who met with the enemies and requested a five-day respite from them, but during that period, one person was killed among them. He said: The blood money (diyat) for him will be obligatory upon the Muslims.
