المعاهد يقتل
Regarding the Ally Who Is Killed
Hadith 29751
٢٩٧٥١ - حدثنا أبو بكر قال: حدثنا حفص قال: سألت عمرًا: ما كان الحسن يقول في المعاهد يقتل؟ قال: إن كانوا يتعاقلون فعلى العواقل، وإن كانوا لا يتعاقلون فدين عليه في ماله (١).
Hazrat Hafs says that I asked Hazrat Umar: What did Hasan Basri say about that ally who has been killed? He replied: If his family members pay the blood money, then it will be obligatory on the family, and if they do not jointly pay the blood money, then it will be a debt upon him in his wealth.
Hadith 29752
٢٩٧٥٢ - حدثنا أبو بكر قال: حدثنا حفص عن أشعث عن الشعبي في المعاهد يقتل قال: ديته للمسلمين، وعقله عليهم.
Hazrat Ash'ath narrates that Imam Sha'bi, regarding the ally who is killed, stated as follows: His blood money will be for the Muslims, and the compensation will be obligatory upon them.
Hadith 29753
٢٩٧٥٣ - حدثنا أبو بكر قال: حدثنا محمد بن بشر عن سعيد عن قتادة في رجل من أهل الذمة فقا عين رجل مسلم، قال: ديته على أهل طسوجه (١).
Hazrat Saeed narrates that Hazrat Qatadah, regarding the dhimmi person who had gouged out the eye of a Muslim man, stated as follows: His blood money will be obligatory upon the people of his locality.
