Musannaf Ibn Abi Shaybah

Hazrat Ismail bin Umayyah narrates that the Messenger of Allah, peace and blessings be upon him, gave the following verdict regarding a person who seized a man and another who killed him: the killer will be killed, and the one who seized will be imprisoned.

Hazrat Aamir narrates that Hazrat Ali (may Allah be pleased with him) gave the verdict to kill the murderer and to imprison the one who captured him.

Hazrat Sha’bah states that I asked Hazrat Hakam and Hazrat Hammad about a person who had seized a man and another killed him. Both of them said: The killer will be killed.

Hazrat Ibn Jurayj says that I heard Hazrat Sulaiman bin Musa saying: Among us, the meaning of being a partner in the case of a murdered person is this: one man holds the person and another kills him, so both of them, in our view, are partners in his blood. Both of them will be killed together.

Hazrat Yahya bin Abu Kathir narrates that two men were brought to Hazrat Ali (may Allah be pleased with him); one of them had committed murder and the other had apprehended him. So, he had the murderer executed, and to the one who had apprehended him, he said: "You apprehended him for death, so I will imprison you in jail until you also die."
