Musannaf Ibn Abi Shaybah

Hazrat Jabir narrates that Hazrat Amir said: Retribution (qisas) will not be taken from the wounded person until his wound has healed.

Hazrat Hisham states that Hasan Basri said: Retaliation (qisas) will not be taken from the one who inflicted the wound until the wound of the injured person has healed.

Hazrat Ibn Jurayj states that Hazrat Ata said: Retaliation (qisas) should be delayed until the wound has healed.

Hazrat Amr bin Dinar narrates that Hazrat Jabir said: A man struck another man’s knee with the horn of a spear, so he came to the Prophet Muhammad (peace be upon him) to seek retribution. He was told to wait until he recovered, but he refused and insisted on immediate retribution. The narrator says: Then his leg broke again, and the leg of the one from whom retribution was taken became healthy. So he came to the Prophet Muhammad (peace be upon him), and he (peace be upon him) said: You have gained nothing; you refused (to wait).
