When One Strikes with a Stone, Then Strikes Again with a Stone
Hadith 29496
٢٩٤٩٦ - حدثنا أبو بكر قال: حدثنا ابن إدريس عن الشيباني عن زياد بن علاقة عن رجل أن رجلًا رمى رجلًا (بجلمود) (١) فقتله، فأقاده رسول اللَّه ﷺ (٢).
Hazrat Zaid bin Alaqah narrates from a man that a person threw a stone at someone and killed him, so the Messenger of Allah (peace and blessings be upon him) took retribution from him.
Hadith 29497
٢٩٤٩٧ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن إبراهيم قال: الضرب بالصخرة عمد وفيها القود.
Hazrat Mughira narrates that Ibrahim said: In the case of striking with a stone, it will be considered intentional murder (‘amdan) and retaliation (qisas) will be obligatory in it.
Hadith 29498
٢٩٤٩٨ - حدثنا أبو بكر قال: حدثنا أبو خالد عن ابن جريج عن (أبي) (١) الزبير عن عبيد بن عمير قال: [يَعمِد الرجلُ الأَيْدُ -يعني الشديدَ- إلى الصخرة أو إلى الخشبة فيشدخ بها رأس الرجل، و (أي) (٢) عمد أعمد من هذا؟.
Hazrat Abu Zubair narrates that Hazrat Ubaid bin Umair said: A strong man picked up a stone or a piece of wood and struck a man's head with it, breaking it. He said: What kind of intentional act could be more severe than this?
Hadith 29499
٢٩٤٩٩ - حدثنا أبو بكر قال: حدثنا شريك عن زيد بن] (١) جبير (عن جَروة) (٢) ابن حُمَيْل عن أبيه قال: قال عمر: يعمد (أحدكم) (٣) إلى أخيه فيضربه بمثل آكلة اللحم (٤)، لا أُوتى برجل فعل ذلك فقتل إلا أقدته منه (٥).
Hazrat Humail narrates that Hazrat Umar said: If any of you intends (to harm) his brother and then kills him with a knife, he said: If such a person who has done this and committed murder is brought to me, I will certainly exact retribution (qisas) from him.
Hadith 29500
٢٩٥٠٠ - حدثنا أبو بكر قال: حدثنا عبد الأعلى عن معمر عن الزهري قال: يضربه بالعصا عمدًا إذا قتلتُ (صاحبَها) (١) قُتل الضارب.
Hazrat Muammar says that Hazrat Zuhri was asked: Will it be considered intentional (murder) when someone strikes with a stick? He replied: In that case, I will execute him like the killer.
Hadith 29501
٢٩٥٠١ - حدثنا أبو بكر قال: حدثنا أبو الأحوص عن أبي إسحاق عن عاصم ابن ضمرة عن علي قال: شبه العمد بالعصى والحجر العظيم (١).
Hazrat Asim bin Damrah narrates that Hazrat Ali (may Allah be pleased with him) said: Qatl Shibh-e-Amad (quasi-intentional murder) occurs in the case of striking with a stick or a large stone.
Hadith 29502
٢٩٥٠٢ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا محمد بن قيس عن الشعبي قال: إذا ضرب بالعصى (فأعاد) (١) وأبدأ قُتل.
Hazrat Muhammad bin Qais narrates that Hazrat Sha'bi said: When someone beats with a stick, then stops, and then starts beating again, that person will be killed.
Hadith 29503
٢٩٥٠٣ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا شعبة قال: سألت الحكم وحمادا عن الرجل يضرب الرجل بالعصى فيقتل، (١) قال الحكم: ليس عليه قود.
Hazrat Sha’bah says that I asked Hazrat Hakam and Hazrat Hammad about a person who killed someone by striking with a stick. Hazrat Hakam said: Qisas (retaliation) will not be taken from him, and Hazrat Hammad said: He will be killed.
Hadith 29505
٢٩٥٠٥ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن جابر عن عامر قال: إذا أعلّ (١) بالعصى فهو قود.
Hazrat Jabir narrates that Hazrat Amir said: When the killer strikes with a stick, then retribution (qisas) will be enforced.
Hadith 29506
٢٩٥٠٦ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا هشام عن قتادة عن أنس أن يهوديًّا رضخ رأس امرأة بحجر فرضخ النبي ﷺ رأسه بين حجرين (١).
Hazrat Qatadah narrates that Hazrat Anas said: A Jew crushed a woman's head with a stone, so the Holy Prophet (peace and blessings be upon him) also crushed his head between two stones.
