Musannaf Ibn Abi Shaybah

Hazrat Abdul Aziz bin Umar narrates that those people who had come to my father told me that the Holy Prophet, peace and blessings be upon him, said: Every healer who treated a people while he had no prior knowledge of treatment, and thus worsened the illness, then that person will be held liable. Abdul Aziz says that this liability is not for the diagnosis of the illness, but rather for cutting veins and making incisions.

Hazrat Hisham states that Hasan Basri said: When the physician exceeds what he was instructed to do, he will be held liable.

Hazrat Ibn Jurayj states that Hazrat Ata said regarding the physician who made an incision in a boil and then the patient died, he said: Blood money will not be obligatory upon him.

Hazrat Abu Qurrah narrates that Hazrat Umar bin Abdul Aziz held the circumciser liable.

Hazrat Saeed bin Yusuf narrates that Hazrat Yahya bin Abi Kathir said: A woman performed circumcision on a girl, causing her pain which led to her death, so Hazrat Ali (may Allah be pleased with him) held that woman liable for blood money.

Hazrat Abu Awn Thaqafi narrates that Hazrat Shurayh said: There will be no liability upon the one who administers medicine.

Hazrat Jabir narrates that Hazrat Sha'bi said: There will be no liability upon the one who administers medicine.

Hazrat Yunus bin Abu Ishaq narrates that I heard Imam Shabi saying: There is no liability (guarantee) upon the one who applies cupping, treats animals, or gives medicine.

Hazrat Jabir narrates that Hazrat Amir Sha'bi, regarding the healer of the animal who pulled out the pus from the horse's eye due to which the horse died, said: He should be held liable.

Hazrat Abu Al-Malih narrates that in Madinah, a woman who performed circumcision performed circumcision on a girl, and as a result, the girl died. Hazrat Umar said to her, "Did you not have any mercy?" And he placed the blood money (diyah) for the girl upon the family of the woman who performed the circumcision.

Ayyub narrates that Hazrat Abu Qilabah said: A woman performed circumcision on some girls, and as a result, she caused them pain and illness. So Hazrat Umar held that woman liable and said, "You did not show even a little mercy."
