Musannaf Ibn Abi Shaybah

Hazrat A'mash narrates that Hazrat Zaid bin Wahb said: A man saw another man with his wife, so he killed his wife. That man was presented before Hazrat Umar, and some brothers of the woman gave their share of the blood money to that man as a gift. So Hazrat Umar ordered all of them to take the blood money.

Hazrat Abu Ma'shar narrates that Ibrahim said: A man intentionally killed another person, so some of the heirs of the murdered person forgave the killer. Then this matter was presented before Hazrat Umar. He said to Hazrat Abdullah bin Mas'ud, "What do you say about this?" Hazrat Abdullah replied: "O Commander of the Faithful! Actually, you are more entitled to speak about this." Then Hazrat Abdullah said: "When some of the heirs have forgiven the killer, then qisas (retaliation) will not be carried out, and the share of those who forgave will be forfeited. The remaining heirs will receive the remaining blood money." Upon this, Hazrat Umar said: "This is the correct opinion, and you have agreed with what was in my heart."

Isa said that Imam Shabi stated: When some heirs have forgiven, then that forgiveness should be followed.

Hazrat Qatadah narrates that Hazrat Umar bin Abdul Aziz said: Whoever forgives will not receive any share.

Hazrat Ibn Tawoos narrates that his father, Hazrat Tawoos, said: When some guardians pardon the blood, then blood money (diyah) will become obligatory.

Hazrat Ash'ath narrates that Imam Zuhri said: The one who forgives has a greater right to blood.
