Musannaf Ibn Abi Shaybah

Hazrat Sha'bi narrates that Hazrat Umar said: The husband and the wife do not have the right to pardon each other.

Hazrat Abu Ma'shar says that Ibrahim stated: The husband and wife do not have the authority to pardon in the case of blood, because the authority to pardon belongs to the heirs of the murdered person.

Ismail narrates that Hasan Basri said: The husband and wife do not have the right to pardon in the case of blood, and if any of the heirs pardons, then his pardon is valid and blood money will be obligatory.

Hazrat Sa'id bin Muslim narrates that Hazrat Sha'bi was asked about a person who had been killed and had left behind a daughter, a sister, and two wives, and one of his two wives forgave the blood of her husband. Upon this, Imam Sha'bi said: A woman does not have the right to forgive except for that woman who is a close blood relative (mahram) of the murdered person and has a share in the inheritance.
