Explanation of Intentional Killing Where Retaliation Is Not Possible
Hadith 29201
٢٩٢٠١ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن إبراهيم قال: ما كان من جرح من العمد لا يستطاع فيه القصاص فهو على الجارح في ماله دون عاقلته.
Hazrat Mughira narrates that Ibrahim said: If a wound is inflicted intentionally and it is not possible to exact retribution for it, then compensation for that wound will be obligatory from the wealth of the one who inflicted it, not from his family members.
Hadith 29202
٢٩٢٠٢ - حدثنا أبو بكر قال: حدثنا غندر عن شعبة قال: سألت الحكم عن العمد الذي لا يستطاع أن يستقاد منه فقال: على العاقلة.
Hazrat Sha’bah says that I asked Hazrat Hakam about such an intentionally inflicted wound in which taking retaliation (qisas) is not possible? He replied: Its blood money (diyat) will be obligatory upon the family members. And I asked Hazrat Hammad? He replied: It will be obligatory from the wealth of that person.
Hadith 29204
٢٩٢٠٤ - حدثنا أبو بكر قال: حدثنا محمد بن يزيد عن أيوب أبي العلاء عن قتادة قال: كل شيء لا يقاد منه فهو على العاقلة.
Ayub Abu Al-Ala reports that Hazrat Qatadah said: Every wound for which it is not possible to exact retribution, its compensation will be upon the family members.
Hadith 29205
٢٩٢٠٥ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: أخبرني هشام عن أبيه قال: كل عمد ليس فيه قود فعقله في مال المصيب، وإن لم يكن له مال فعلى عاقلة المصيب إن قطع (يمينًا) (١) عمدًا، (و) (٢) كانت يمين القاطع قد قطعت ⦗١٥٤⦘ قبل ذلك فعقلها في مال القاطع، (فإن) (٣) لم يكن له مال فعلى عاقلته، وإن كانت له يد يسرى لم يقد منها، والعقل كذلك، (و) (٤) الأعضاء كلها كذلك.
Hazrat Hisham bin Urwah narrates that Hazrat Urwah said: In every case of intentional injury where retaliation (qisas) is not possible, the blood money (diyat) will be obligatory from the wealth of the one who inflicted the wound, and if he does not have wealth, then it will be obligatory upon his family. That is, if someone intentionally cuts off another person's right hand and the perpetrator's right hand was already cut off, then the blood money will be obligatory from the wealth of the perpetrator, and if he does not have wealth, then it will be obligatory upon his family, even if his left hand is present; still, retaliation will not be carried out, and the same ruling will apply regarding the blood money. This same ruling applies to all other limbs as well.
