Hadith 29175
٢٩١٧٥ - حدثنا أبو بكر قال: حدثنا حفص عن الحجاج عن القاسم بن (نافع) (١) قال: قال عمر (٢): ما أصاب المنفلت فلا ضمان على صاحبه، ومن أصاب المنفلت ضمن (٣).
Hazrat Qasim bin Nafi states that Hazrat Umar said: If an unbridled animal causes any damage, there will be no liability on its owner, but if someone causes harm to an unbridled animal, that person will be held liable.
Hadith 29176
٢٩١٧٦ - حدثنا أبو بكر قال: حدثنا عبد السلام عن عمرو عن الحسن وابن سيرين في الدابة (المرسلة) (١) تصيب. قالا: ليس عليه ضمان.
Hazrat Amr narrates that Hasan Basri and Hazrat Ibn Sirin were both asked about an animal that had been set free and caused harm to someone. Both of them replied that there would be no liability upon its owner.
Hadith 29177
٢٩١٧٧ - حدثنا أبو بكر قال: حدثنا أبو خالد عن أشعث عن الشعبي قال: كل مرسلة فصاحبها ضامن.
Hazrat Ash'ath narrates that Hazrat 'Amir Sha'bi said: In the case of any harm caused by a freed animal, its owner will be held liable.
Hadith 29178
٢٩١٧٨ - حدثنا أبو بكر قال: حدثنا غندر عن شعبة عن حماد في رجل انفلتت دابته وهو في أثرها، فأصابت إنسانًا، قال: ليس عليه شيء.
Hazrat Shu’bah states that Hazrat Hammad gave a ruling regarding a person whose animal broke free from its reins and ran away, causing harm to someone while the person was searching for it. He said: There will be no liability upon him, and Hazrat Hakam also gave the same ruling.
