Musannaf Ibn Abi Shaybah

It is narrated from Qazi Shurayh regarding the slave who injures a free person that if he wishes, he may take retribution, and if he wishes, he may take compensation for his wound.

Ibrahim said that when a free man intentionally injures someone, only blood money (diyah) will be required in compensation, and there will be no retaliation (qisas) against him.

Hazrat Umar bin Abdul Aziz said that retribution (qisas) will not be taken from a free man in exchange for a slave.

Ibrahim said that there is no qisas between slaves and free people "in matters less than the soul" (i.e., there is no qisas except in the case of murder).

Hazrat Ibn Jurayj said that I asked Ata: If a slave injures a free man or blinds his eye, and then the free man wants to take retribution from him, what is the ruling? He replied that a free man cannot take retribution from a slave, and similarly, Hazrat Mujahid and Sulaiman bin Musa have also said this.

Hazrat Ibn Jurayj said that I received this information from Salim that retaliation (qisas) will not be taken from a freed slave.

Hazrat Zuhri said that there is no other retribution between a free man and a slave except that if a slave kills a free man, then the slave will also be killed in retaliation.
