Musannaf Ibn Abi Shaybah

Hazrat Shurayh said that if a person’s eye is gouged out, and it was his only eye, then retribution (qisas) is due in return; and if it was gouged out by mistake, then half of the blood money (diyah) is due for it.

It is narrated from Hazrat Masruq that for injuring the eye of a one-eyed person, half of the blood money (diyah) is due. Should I also pay diyah for the eye that Allah has already injured?

Hazrat Sha'bi said that if a person's sound eye is deliberately damaged, then an eye will be taken in return for that eye (i.e., retribution will be carried out).

Hazrat Abdullah bin Mughaffal said that for putting out the sound eye of a one-eyed person, there is (retaliation of) an eye (i.e., Qisas). I did not put out his first eye.

Hazrat Ata bin Abi Rabah said that in this there is half the blood money (diyah).

Ibrahim said that in this there is half the blood money.

It is narrated from Hazrat Masruq that he was asked about the gouging of the eye of a one-eyed person. He replied: I will not pay the blood money for the eye that Allah has already destroyed; only the blood money for one eye will be obligatory upon the one who caused the injury.
