Hadith 28612
٢٨٦١٢ - (حدثنا أبو بكر قال) (١): حدثنا ابن نمير عن حجاج عن مكحول عن زيد بن ثابت قال: إذا ضرب الرجل حتى يذهب سمعه ففيه الدية (٢).
Hazrat Zaid bin Thabit said that if a person is beaten so much that he loses his hearing, then blood money (diyat) is due for it.
Hadith 28613
٢٨٦١٣ - حدثنا أبو بكر قال: حدثنا عبد الأعلى عن يونس عن الحسن في رجل ضُرب فذهب سمعه وبصره وكلامه قال: له ثلاث ديات.
It is narrated from Hasan that he said: Whoever is struck and loses his hearing, speech, and sight, then there will be three blood monies (diyahs) for him.
Hadith 28614
٢٨٦١٤ - حدثنا أبو بكر قال: حدثنا أبو خالد عن عوف قال: سمعت شيخًا (قبل) (١) فتنة ابن الأشعث (فنعت نعته) (٢) (قالوا) (٣): ذاك أبو المهلب عم أبي قلابة ⦗٤٤⦘ قال: رُمي رجل (٤) بحجر في رأسه فذهب سمعه ولسانه وعقله وذكره فلم (يقرب) (٥) (النساء) (٦) فقضى فيه عمر (بأربع) (٧) ديات (٨).
Hazrat Auf narrates that I heard from an old man before the turmoil of Ibn al-Ash'ath that a man was struck by a stone on his head, which caused him to lose his intellect, memory, hearing, and speech, and he was no longer capable of being with women. So Umar gave the verdict of four blood monies (diyahs) regarding him.
Hadith 28615
٢٨٦١٥ - حدثنا أبو بكر قال: حدثنا عمر (عن) (١) يونس عن الزهري عن سعيد ابن المسيب قال: في السمع الدية.
Hazrat Saeed bin Musayyib has said that there is diyah (blood money) for hearing.
Hadith 28616
٢٨٦١٦ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: أخبرني ابن أبي نجيح عن مجاهد قال: في ذهاب السمع خمسون.
Hazrat Mujahid said that upon the loss of hearing, the compensation is fifty camels.
Hadith 28617
٢٨٦١٧ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال (١): سألت عطاء عن رجل أصيب من أطرافه ما (قدره) (٢) أكثر من ديته؟ فقال: ما سمعت فيه بشيء وإني لأظنه سيعطى بكل ما أصيب منه، وإن كان أكثر من (ديته) (٣).
Hazrat Ibn Jurayj said that I asked Ata about a person who had such wounds on his sides and surroundings that their amount exceeded his blood money (diyah)? So he replied that I have not heard anything about this, and I think that compensation should be given for all the wounds on his sides, even if it exceeds his blood money.
Hadith 28618
٢٨٦١٨ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: قال ابن شهاب في رجل فقأ عين صاحبه وقطع أنفه وأذنه قال: يحسب ذلك كله.
Hazrat Ibn Jurayj states that Ibn Shihab said regarding a person who gouged out his companion’s eye and cut off his nose and ear, that the value of all these will be calculated in full.
Hadith 28619
٢٨٦١٩ - حدثنا أبو بكر قال: حدثنا محمد بن بشر قال: حدثنا سعيد عن قتادة (أن) (١) الحسن سئل عن رجل رمي بحجر أو ضُرب على رأسه فذهب سمعه وبصره وانقطع كلامه فقال: ديات، في سمعه (دية) (٢)، وفي بصره (دية) (٣)، وفي لسانه دية، (فقيل) (٤) للحسن: ربح، فقال: واللَّه ما ربح ولا أفلح.
It is narrated from Qatadah that Hasan was asked about a person who was struck with a stone or his head was struck, then his ability to speak was lost and his sight and hearing also went away? So Hasan said that several blood monies (diyahs) would be obligatory in this case: one for his ear, one for his eyes, and one for his tongue. So it was said to Hasan, "Then he is well off." He replied, "He is neither well off nor has he attained success."
