When Two People Share Ownership of an Item
Hadith 24869
٢٤٨٦٩ - (حدثنا أبو بكر قال) (١): حدثنا جرير عن مغيرة عن حماد في رجلين ⦗٧٤⦘ كانت بينهما أمة (اشترياها) (٢) بأربعين دينارا، فأرادا أن (يبيعاها) (٣) مرابحة، فأعطيا (بها) (٤) خمسين دينارا، (فاشتراها) (٥) أحدهما، ثم أراد أن يبيعها مرابحة، قال: يبيعها على خمسة وأربعين دينارا، تلك الخمسة ربحها نفسه.
It is narrated from Hazrat Hammad that there was a slave girl jointly owned by two men, whom they had bought for forty dinars. Then they intended to sell her on a murabaha basis, and they received fifty dinars. Then one of them bought her himself. If he then wishes to sell her on a murabaha basis, he will sell her for forty-five dinars, and the five dinars will be his profit.
