A Person Claims Something with Another
Hadith 24508
٢٤٥٠٨ - حدثنا أبو بكر قال: حدثنا محمد بن (يزيد) (١) عن أيوب (أبي) (٢) العلاء عن قتادة وأبي هاشم في رجل ادعى قِبَل رجل مالا، فقال: أعطني كفيلا حتى آتي ببينتي، (قالا) (٣): ليس له ذلك.
If a person claims that someone else has his property and says, "Until I bring a witness, give me a guarantor for my property," regarding such a person, Hazrat Qatadah and Hashim state that he does not have this right.
Hadith 24509
٢٤٥٠٩ - حدثنا أبو بكر قال: حدثنا عبيد اللَّه (بن) (١) موسى قال: (حدثنا) (٢) سفيان عن عقبة بن أبي العيزار قال: أتيت الشعبي برجل (لي) (٣) عليه حق لم يكن (لي) (٤) عليه بينة، فقال: خذ لي منه كفيلا، فأبى أن يأخذ لي منه كفيلا.
Hazrat Uqbah bin Abu Al-Aizar narrates that I came to Hazrat Sha'bi with a man upon whom I had a right, but there were no witnesses against him. I requested: Take a guarantor from him for me, but he refused to take a guarantor for me.
