Musannaf Ibn Abi Shaybah

Hazrat Ibn Sirin says that if a person buys cloth with a condition and, before becoming its rightful owner, sells it ahead on a murabaha basis, then whatever profit is made will go to the owner of the cloth.

Muhammad, may Allah have mercy on him, said that if a person buys a commodity with a condition and sells it before its rightful owner appears, then whatever profit is made from it will belong to the first person.

Hazrat Tawus says that when a sale is made with the option of choice (khiyar), and then before the owner comes, it is sold further, then this sale is valid and this profit is lawful for him.

Hazrat Utbah says that I said to Hazrat Shurayh (may Allah have mercy on him): I will go to the market and buy cloth, and I will stipulate a condition of option (khiyar al-shart) in it. Then I will come back and sell it; if there is profit, fine, otherwise I will return it. So how is it to do this? He replied: Do not do this.
