Shafi‘ Allows Buyer to Purchase
Hadith 24241
٢٤٢٤١ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن أشعث عن الحكم قال: إذا أذن الشفيع للمشتري في الشراء فاشترى فلا شفعة له.
Hazrat Hakam states that if the pre-emptor himself gives permission to the buyer to purchase, and the buyer purchases, then the pre-emptor no longer has the right to take possession of it.
Hadith 24242
٢٤٢٤٢ - حدثنا أبو بكر قال: حدثنا وكيع قال: (قال) (١) سفيان: له الشفعة لأن حقه وقع بعد البيع.
Hazrat Sufyan says that he will have the right of pre-emption, because his right has arisen after the sale has taken place. (It has been established)
