Hadith 24209
٢٤٢٠٩ - حدثنا أبو بكر قال: حدثنا أبو معاوية عن الشيباني عن حماد عن إبراهيم قال: الشفعة للمشرك والأعرابي و (غيرهما) (١).
Ibrahim says that the right of pre-emption applies to a polytheist and a Bedouin. Shu’bi says that the right of pre-emption does not apply to a polytheist and a Bedouin.
Hadith 24211
٢٤٢١١ - حدثنا أبو بكر قال: حدثنا شريك عن ليث عن مهاجر عن الشعبي قال: ليس (لأعرابي) (١) و (لا) (٢) لمن لا يسكن المصر (شفعة) (٣).
Hazrat Sha'bi says that there is no right of pre-emption for a Bedouin and for a person who is not a resident of the city.
Hadith 24212
٢٤٢١٢ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن حميد عن (الحسن) (١) قال: ليس لليهودي و (لا) (٢) (للنصراني) (٣) شفعة.
Hasan says that a Jew and a Christian do not have the right of pre-emption.
Hadith 24213
٢٤٢١٣ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا جرير بن حازم عن (١) المقدام (أبي فروة) (٢) قال: حدثني جار لي أن شريحًا قضى لنصراني (بشفعة) (٣).
It is narrated from Hazrat Miqdam Abu Farwah that Hazrat Shurayh, may Allah have mercy on him, gave a verdict of pre-emption in favor of a Christian.
Hadith 24214
٢٤٢١٤ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا قيس بن الربيع عن خالد الحذاء قال كتب عمر بن عبد العزيز: لليهودي والنصراني شفعة.
Hazrat Umar bin Abdul Aziz wrote that the Jew and the Christian have the right of pre-emption.
Hadith 24215
٢٤٢١٥ - حدثنا أبو بكر قال: حدثنا (حسن) (١) بن صالح (عن الشيباني) (٢) عن الشعبي قال: ليس (ليهودي) (٣) ولا نصراني شفعة.
Hazrat Sha'bi (may Allah have mercy on him) says that a Jew and a Christian do not have the right of pre-emption.
Hadith 24216
٢٤٢١٦ - [حدثنا أبو بكر قال: حدثنا وكيع قال: (قال) (١) (لنا) (٢) سفيان: لليهودي والنصراني شفعة] (٣).
Hazrat Sufyan says that the Jew and the Christian have the right of pre-emption.
Hadith 24217
٢٤٢١٧ - حدثنا أبو بكر قال: حدثنا ابن (أبي) (١) عدي عن أشعث عن الحسن قال: كان (لا) (٢) يرى للكفار شفعة.
Hasan (may Allah have mercy on him) did not see any harm in the right of pre-emption for the disbelievers.
