Musannaf Ibn Abi Shaybah

It is narrated from Hazrat Ali (may Allah be pleased with him) and Hazrat Abdullah that the Holy Prophet (peace and blessings be upon him) decreed the right of pre-emption for the neighbor.

The Prophet ﷺ gave a verdict in favor of the neighbor's right.

It is narrated from Hazrat Abu Rafi‘ in a marfu‘ form that the Holy Prophet (peace and blessings be upon him) said: The neighbor has a greater right to pre-emption.

It is narrated from Hazrat Samurah that the Holy Prophet (peace and blessings be upon him) said: The neighbor of the house (through pre-emption) has more right to that house.

The Noble Prophet (peace and blessings be upon him) said: If the path of the neighbors is one, then the neighbor of the house has a greater right to pre-emption, and if he is not present, then he will be waited for.

The Noble Prophet (peace and blessings be upon him) said: The one entitled to pre-emption (shuf‘a) has more right than the neighbor, and the neighbor who is closer has more right than the one who is farther. (Or it means that if the one entitled to pre-emption is a neighbor, then he has more right, and if the neighbor is also closer, then he has even more right.)

The Noble Prophet (peace and blessings be upon him) decreed the right of pre-emption for neighbors.

Hazrat Umar (may Allah be pleased with him) wrote a letter to Hazrat Shurayh to decide the right of pre-emption (shuf‘a) in favor of neighbors. Hazrat Shurayh used to decide the right of pre-emption for a resident of Kufa over a resident of Syria.

Hazrat Sha'bi (may Allah have mercy on him) said: The partner has more right than the intercessor, and the intercessor has more right than the neighbor, and the neighbor has more right than the rest.

Ibrahim says that the partner in pre-emption has more right, and if there is no partner, then the neighbor has more right.

Ibrahim says that a partner has more right than a neighbor, and a neighbor has more right than others.

Hazrat Amr bin Harith used to decide the right of pre-emption (shuf‘a) in favor of neighbors.

Hazrat Thareed narrates that I submitted, "O Messenger of Allah ﷺ! In a land, no one has any share or partnership except for its neighbor. In this case, whose right is it to pre-emption (shuf‘a)?" The Prophet ﷺ replied: "The neighbor has more right to his pre-emption (shuf‘a)."

Muhammad, may Allah have mercy on him, said: If a person has a partnership in land or a house, it is not permissible for him to sell it without the permission of his partner. If his partner wishes, he may buy it himself, and if he wishes, he may not buy it.
