Musannaf Ibn Abi Shaybah

The Noble Prophet (peace and blessings be upon him) said: Whoever sells a date-palm tree after it has become sound (after it has borne fruit), then if the buyer does not stipulate a condition, the fruit will belong to the seller. And whoever sells a slave who possesses wealth, then if the buyer does not stipulate a condition, that wealth will belong to the seller.

The Noble Prophet (peace and blessings be upon him) said: Whoever buys a slave who possesses wealth, if the buyer does not stipulate a condition regarding that wealth, then the wealth will belong to the seller.

The Noble Prophet (peace and blessings be upon him) said: Whoever buys a slave who possesses some wealth, then that wealth will belong to the seller, unless the buyer stipulates with these words that "I buy him and his wealth from you." And whoever buys a tree whose fruits have ripened, then its fruits will belong to the seller, unless the buyer also stipulates for the fruits.

It is also narrated in a similar manner from Hazrat Jabir and Hazrat Abdullah bin Umar (may Allah be pleased with them).

The Noble Prophet (peace and blessings be upon him) said: Whoever buys a slave who possesses some wealth, then that wealth will belong to the seller, unless the buyer stipulates with these words that "I buy him and his wealth from you." And whoever buys a tree whose fruits have ripened, then its fruits will belong to the seller, unless the buyer also stipulates for the fruits.

Hazrat Umar (may Allah be pleased with him) said that if a person buys a slave who also possesses some wealth, then that wealth will belong to the master, unless the buyer stipulates a condition, in which case it will belong to the buyer.

Hazrat Abdullah bin Utbah and Hazrat Shurayh state: If a slave is sold and he possesses some property, then that property will belong to the purchaser.

Shu’bah says that I asked Hakam about this matter, so he, may Allah have mercy on him, said: The wealth will belong to the buyer.

Hazrat Tawus was asked: If a person, at the time of purchasing a slave, also stipulates a condition regarding his property, what is the ruling? He replied: His property will go to him (the buyer), and if the buyer does not stipulate a condition, the property will belong to the master (seller).

Ibrahim says that if a slave possessing wealth is sold, then the wealth will belong to the buyer.

Hasan also says the same.

Muhammad (may Allah have mercy on him) said that if a person, while selling a slave, says: "I sell this slave and his property," then there is no harm in it.
