Musannaf Ibn Abi Shaybah

It is narrated from Hazrat Ata that the Holy Prophet (peace and blessings be upon him) said: Muslims will conduct their dealings according to their conditions.

Hazrat Umar (may Allah be pleased with him) said that a Muslim will act according to his condition.

Hazrat Shurayh says that a Muslim will act according to his condition (stipulation) as long as there is no disobedience to Allah in it.

Hazrat Shurayh (may Allah have mercy on him) says that it is necessary for every Muslim to act upon his condition (stipulation).

Ismail narrates that a woman came to Hazrat Sha’bi (may Allah have mercy on him) and said: My daughter has made a sale with the condition that she will not be sold. He replied: Your daughter is bound by her condition. (It is necessary to act upon this condition.)

It is narrated from Hazrat Amr bin Rashid that a man bought a camel from someone; the camel was sick. The seller made an exception for the camel’s skin. Later, the camel recovered. Both of them took their dispute to Hazrat Umar (may Allah be pleased with him). Hazrat Umar (may Allah be pleased with him) sent them to Hazrat Ali (may Allah be pleased with him). Hazrat Ali (may Allah be pleased with him) said: The price of the camel should be assessed in the market, and he should be given the equivalent of the skin.

Hazrat Shurayh (may Allah have mercy on him) also says the same.

Hazrat Zaid was asked that a person sold a camel to someone and stipulated the condition of the head, he replied that he will be given something equivalent to the head.

It is narrated from Hazrat Muhammad, may Allah have mercy on him, that a person sold a sick camel to another and made a condition regarding its head and skin (i.e., excepted them). The camel recovered, and that person did not slaughter it. Hazrat Shurayh, may Allah have mercy on him, said: He should be given its equivalent. The narrator says that I mentioned this to Hazrat ‘Amir, and he said: Both Hazrat ‘Ali, may Allah be pleased with him, and Hazrat Shurayh, may Allah have mercy on him, gave the verdict of equivalence.

Hazrat Ali (may Allah be pleased with him) said: Muslims conduct their dealings according to their conditions.

Hazrat Umar (may Allah be pleased with him) said: The fulfillment of rights should be according to the condition.
