Musannaf Ibn Abi Shaybah

Hazrat Masruq (may Allah have mercy on him) was asked about a person who freed his slave during his terminal illness and he has no other wealth besides this? He (may Allah be pleased with him) replied: This decision of his will be enforced on the Day of Judgment; I cannot reject what he has freed for the sake of Allah. And Hazrat Shurayh (may Allah have mercy on him) said: It will be enforced on one-third of his wealth, and for the remaining two-thirds, he (the slave) will strive (by giving wealth, he will be freed).

23139 - And he said: Shurayh permitted a third of it and required him to seek freedom for (two-thirds) (1).

Ismail says: I asked Hazrat Sha’bi (may Allah have mercy on him), “Which of the two statements do you prefer?” He (may Allah have mercy on him) replied: “I prefer the statement of Hazrat Masruq (may Allah have mercy on him) in issuing a fatwa, and I prefer the statement of Hazrat Shurayh (may Allah have mercy on him) in judicial matters.”

Hazrat Ibn Masood (may Allah be pleased with him) said: A third of it will be counted as freed.

Ibrahim (may Allah have mercy on him) said regarding a person who, in his terminal illness, frees his slave and has no other wealth besides this: one-third of the slave will be considered freed, and for the remaining two-thirds, he will make an effort?

Hazrat Sha'bi (may Allah have mercy on him) says that if a person makes a bequest to free his slave, then that bequest will be executed from one-third of the wealth. If the value of the slave is more than one-third, then for the excess amount, the slave will strive to pay it.
