Hadith 23133
٢٣١٣٣ - حدثنا أبو بكر قال: حدثنا حفص بن غياث عن حجاج عن العلاء بن بدر عن أبي (يحيى) (١) (الأعرج) (٢) قال: سئل النبي ﷺ عن عبد أعتقه مولاه عند موته وليس له مال (غيره) (٣) وعليه دين، قال: فأمره النبي ﷺ أن يسعى في الدين (٤).
It is narrated from Hazrat Abu Yahya Al-A'raj (may Allah be pleased with him) that it was asked from the Noble Prophet (peace and blessings be upon him) that a slave was set free by his master at the time of his (the master's) death, and he (the master) had no other wealth besides him, and there is also debt upon him (the master). The Holy Prophet (peace and blessings be upon him) ordered that the slave should strive to pay off his master's debt.
Hadith 23134
٢٣١٣٤ - حدثنا أبو بكر قال: حدثنا حفص عن حجاج (عن) (١) قتادة عن الحسن قال: سئل علي عن رجل أعتق عبدًا له عند موته وليس له مال غيره وعليه دين قال: يعتق ويسعى في القيمة (٢).
It is narrated from Hazrat Hasan (may Allah be pleased with him) that Hazrat Ali (may Allah be pleased with him) was asked about a person who, at the time of his death, set his slave free and had no other wealth besides this, and he was also in debt? He (may Allah be pleased with him) replied: The slave will be set free, but he will strive to the extent of his value.
Hadith 23135
٢٣١٣٥ - حدثنا أبو بكر قال: حدثنا حفص عن حجاج عن القاسم قال: أعتقت امرأة جارية (١) ليس لها مال غيرها، فقال: عبد اللَّه تسعى في قيمتها (٢).
It is narrated from Hazrat Qasim, may Allah have mercy on him, that a woman freed her slave-girl and she had no other wealth besides her. Hazrat Abdullah, may Allah be pleased with him, said: She will strive to pay her value.
Hadith 23136
٢٣١٣٦ - حدثنا أبو بكر قال: حدثنا عبد السلام بن حرب عن مغيرة عن حماد عن إبراهيم في رجل أعتق عبدًا له في مرضه ثم مات وعليه دين وليس ⦗١٦٤⦘ (له) (١) مال غيره، قال: [يسعى في قيمته، فإن كانت القيمة أكثر من الدين يسعى الغرماء في دينهم، ونظر ما بقي من شيء فللورثة ثلثاه وله ثلثه.
Ibrahim (may Allah have mercy on him) said regarding the person who, in his terminal illness, freed his slave and then died, and he also had a debt upon him, and besides this slave he had no other wealth: he said, the slave will strive to the extent of his value; if his value is more than the debt, then he will strive for the creditors to the extent of their debt, and whatever remains will be considered; then two-thirds of it will belong to the heirs and one-third will be his (i.e., for the bequest).
Hadith 23137
٢٣١٣٧ - حدثنا أبو بكر قال: حدثنا ابن فضيل عن مطرف عن الشعبي في رجل أعتق عبده عند موته وليس له مال غيره، قال] (١): يقوم قيمة عدل ثم يسعى في قيمته.
Hazrat Sha'bi (may Allah have mercy on him) says that if a person frees a slave during his terminal illness and he has no other wealth besides this, then a just person will estimate the value of that slave, and then the slave will strive to pay that value.
