Musannaf Ibn Abi Shaybah

Ibrahim (may Allah have mercy on him) was asked about a slave who secretly gives dirhams to someone else so that he may buy him and set him free? He replied: If the master takes possession of the slave before the other person sets him free, then he will take both the slave and his price. And if he takes possession after the other person has set him free, then after the emancipation, whatever amount remains, he will take it from the purchaser as 'atiq (price for emancipation).

Ibrahim (may Allah have mercy on him) said that he will then receive its price, and the wala’ (right of inheritance) of the slave will go to the one who set him free.

Hazrat Hasan (may Allah be pleased with him) says that neither its purchase is valid nor its freeing; whoever does such an act is a transgressor.

Hazrat Sha'bi (may Allah have mercy on him) was asked about a person who concealed another's wealth and bought a slave with it, then set him free. Hazrat Sha'bi (may Allah have mercy on him) said: If I catch that person, I will give him a severe punishment for this act.

Hazrat Hakam gives the ruling regarding the person about whom a slave came to him and gave him wealth and said, "Buy me." That person bought the slave and then set him free. Later, when he became aware of this, he (Hazrat Hakam) said, "The sale is valid, and the price for which the slave was bought will be taken."

Hazrat Aamir, Hazrat Salim, Hazrat Qasim, and Hazrat Ata (may Allah have mercy on them) state that if a slave gives wealth to a person and that person uses this wealth to purchase and free the slave, then this is not permissible.

Hazrat Sha'bi (may Allah have mercy on him) says that doing so is not permissible, and whoever does so will be punished.

Hazrat Hasan (may Allah be pleased with him) and Hazrat Ibn Sirin (may Allah have mercy on him) say that doing so is not permissible. Whoever does so is a transgressor.
