Musannaf Ibn Abi Shaybah

It is narrated from Hazrat Makharraq that Hazrat Ali (may Allah be pleased with him) sent Hazrat Muhammad bin Abu Bakr (may Allah be pleased with him) to Egypt. He wrote a letter to him from Egypt and inquired about a mukatab (contracted slave) who dies leaving behind wealth and children. He (may Allah be pleased with him) wrote to him regarding the mukatab: If he dies leaving wealth for the payment of his contract, his master should be called and the amount due for the contract should be fully paid to him. Whatever remains after that will be inherited by his children.

Ismail (may Allah have mercy on him) says that I asked Sha'bi (may Allah have mercy on him) that regarding the mukatab who dies leaving behind wealth and children, what decision did Shurayh (may Allah have mercy on him) make? He replied: Whatever amount of the contract of emancipation remains, it will be paid to his master, and whatever wealth remains will go to his children. Sha'bi (may Allah have mercy on him) said: Shurayh (may Allah have mercy on him) gave this verdict according to the statement of Abdullah (may Allah be pleased with him).

Ibrahim (may Allah have mercy on him) said that if any wealth remains, it will go to the master until the contract of emancipation is fully paid. And whatever wealth remains after that will go to the heirs.

It is narrated from Ibrahim, may Allah have mercy on him, in a similar manner.

Hazrat Umar (may Allah be pleased with him) and Hazrat Zaid bin Thabit (may Allah be pleased with him) say that if a mukatab dies leaving behind wealth, that wealth will go to the master; his children will not receive anything.

Hazrat Abdullah (may Allah be pleased with him) regarding the mukatab who dies leaving behind wealth and free children, says: The remaining amount of the contract of manumission will be paid, and whatever wealth remains after that will go to his children.
