Musannaf Ibn Abi Shaybah

Hazrat Shurayh (may Allah have mercy on him) says regarding the mukatab who dies in such a state that he has debt and the his installments for manumission is also remaining, then the obligatory his installments for manumission will be paid before the debt.

Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) says that although Hazrat Shurayh (may Allah have mercy on him) was a judge, he made a mistake. Hazrat Zaid bin Thabit (may Allah be pleased with him) used to say that the debt will be paid before the contract of Mukatabah.

Ibrahim (may Allah have mercy on him) said that if a mukatab slave dies while he is in debt, then his master will be placed alongside the creditors. Whatever of the installments is due will be given first, and if no installment is immediately due, then the creditors will be given precedence, so they will recover their debt. If anything remains after that, it will go to the masters until the price of manumission is completed, and if anything remains even after the price of manumission has been paid, then it will go to his heirs.

Ibrahim (may Allah have mercy on him) says that his master will be joined with the creditors for the installment that has become due from the installments.

Hasan (may Allah have mercy on him) said: "We will begin with the debt."

Hazrat Shurayh (may Allah have mercy on him) said: "We will begin with the debt."

Hazrat Sha'bi (may Allah have mercy on him) and Hazrat Hakam state that if a slave has debt and the compensation for the contract of emancipation (mukatabat) is also remaining, then the installment that has become due will be considered, and whatever portion of it belongs to his creditors will be distributed among them according to their respective shares.

Hasan, Hazrat Sufyan, and Hazrat Ibn Abi Laila (may Allah have mercy on them) state that if a slave passes away and there is still debt upon him, then whatever was upon him will become immediately due, and his master will include all the property in the contract of manumission along with the creditors.
