If a Mukatab Is Unable to Pay, He Is Returned to Slavery
Hadith 22752
٢٢٧٥٢ - حدثنا أبو بكر قال: حدثنا عباد بن العوام عن حجاج عن حصين (الحارثي) (١) عن علي قال: إذا تتابع على المكاتب نجمان فدخل في السنة فلم (يؤد) (٢) نجومه رد في الرق (٣).
Hazrat Ali (may Allah be pleased with him) says that if a mukatab continuously fails to pay two installments of his contract, he will be entered into the Bayt al-Mal; if he fails to pay one installment, he will be returned to slavery.
Hadith 22753
٢٢٧٥٣ - حدثنا أبو بكر قال: حدثنا أبو بكر بن عياش عن مغيرة عن إبراهيم قال: (إذا قال المكاتب) (١): قد عجزت، رد رقيقًا.
Ibrahim (may Allah have mercy on him) said that if a mukatab himself says that he is unable to pay the compensation of the contract of manumission, then he will be returned to slavery.
Hadith 22754
٢٢٧٥٤ - حدثنا أبو بكر قال: حدثنا وكيع وابن أبي زائدة عن أبان بن عبد اللَّه البجلي عن عطاء أن ابن عمر كاتب غلامًا له على ألف دينار فأداها، (إلا) (١) مائة فرده (في الرق) (٢) (٣).
Hazrat Ata (may Allah have mercy on him) narrates that Hazrat Ibn Umar (may Allah be pleased with them both) made his slave a mukatab for one thousand dinars. The slave paid all the money except for one hundred dinars. Hazrat Ibn Umar (may Allah be pleased with him) returned him to slavery.
Hadith 22755
٢٢٧٥٥ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن الحارث (العكلي) (١) قال: إذا دخل (نجم) (٢) في نجم (فقد) (٣) استبان عجزه (٤).
Hazrat Harith Akli states that when the installment of the contract of emancipation (badal kitabah) enters into the second installment, then the incapacity of the slave seeking emancipation (mukatab) will be established.
Hadith 22756
٢٢٧٥٦ - حدثنا أبو بكر قال: حدثنا ابن نمير عن حجاج عن الحكم عن إبراهيم عن شريح أنه كان يرد المكاتب إذا عجز ولا (يستأني) (١) به.
Hazrat Shurayh (may Allah have mercy on him) returned the mukatab to slavery when he became unable to pay the substitute for the contract of manumission.
Hadith 22757
٢٢٧٥٧ - حدثنا أبو بكر قال: حدثنا بن أبي زائدة عن حجاج عن عمرو بن شعيب عن أبيه عن جده عن النبي ﷺ قال: "إذا كاتب غلامه على مائة أوقية فأداها (إلا عشر) (١) (أواق) (٢) ثم عجز رد في الرق" (٣).
It is narrated from Hazrat Amr bin Shu'aib that the Noble Prophet (peace and blessings be upon him) said: When a person makes a slave a mukatab for one hundred uqiyah, and then that slave pays all except ten uqiyah, but becomes unable to pay those ten, then he will be returned to slavery.
Hadith 22758
٢٢٧٥٨ - حدثنا أبو بكر قال: حدثنا محمد بن (يزيد) (١) عن أبي العلاء عن الحكم قال: لا يرد حتى يعجز عن (سنتين) (٢).
Hazrat Hakam (may Allah have mercy on him) says that if a mukatab becomes unable to pay the installments for several years, then he will be returned to slavery again.
