Musannaf Ibn Abi Shaybah

Hasan (may Allah have mercy on him) says that the mudarib will spend from the entire capital, and Ibn Sirin (may Allah have mercy on him) says that it is not so.

22617 - Ibn Sirin said: (It is not) (1) so.

Ibrahim (may Allah have mercy on him) said that the mudarib will spend and use clothes of average quality; if he makes a profit, it will be from his profit, and if he incurs a loss, it will be from the principal. The narrator says: I asked Hasan Ibn Sirin (may Allah have mercy on him) about this. He said: I do not like spending without the permission of the owner of the capital.

22619 - He said: I asked Ibn Sirin, and he said: I do not like that he should spend until he seeks permission from the owner of the wealth.

Hazrat Hammad says that if the mudarib wishes, he can hire a laborer on wages and can feed a slave if he is from the mudarabah, but he himself should not eat with them.

Hazrat Hammad says that no condition will be stipulated for the mudarib regarding food or anything from which he benefits; however, if it is for the benefit of the mudarabah, then it is permissible. If it is not for the benefit of the mudarabah, then it will be considered from his personal wealth.

Hazrat Qasim and Salim were asked whether the mudarib can eat and drink from that money, ride (an animal), and wear clothes, etc.? They replied that if it is due to the reason of mudarabah, then there is no harm.
