Musannaf Ibn Abi Shaybah

It is narrated from Hazrat Jabir (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) forbade making a sale in which a certain (unknown) portion is separated.

Hazrat Amr bin Shu'aib narrates that I asked Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him): Can I sell the fruits of my land and separate some portion from it? He replied: Do not make an exception; if you must, then separate a specific tree, but do not exempt it from charity either. The narrator says that I mentioned this to Hazrat Muhammad bin Sirin (may Allah have mercy on him), and he approved of this opinion.

Hazrat Qasim (may Allah have mercy on him) says that if Hazrat Ibn Umar (may Allah be pleased with both of them) did not dislike separating some unspecified portion, and if it were up to our own choice, then we would not see any harm in it. Ibn 'Alyah, the narrator, adds that Hazrat Ibn Umar (may Allah be pleased with both of them) used to say: I will not sell this particular tree, I will not sell this particular tree.

Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) disliked that some of the date trees be bought by measuring their produce.

Hazrat Abu Hamza, may Allah have mercy on him, says that I asked Ibrahim, "I sold a goat to a man and excluded a part of it; is this permissible?" He replied, "It is not correct. Rather, you should say to him, 'I sell you half of the goat.'"

It was asked from Hazrat Jabir (may Allah be pleased with him) that a person sells something and exempts a part of it? He replied: This is not correct.

It was asked from Hasan (may Allah have mercy on him) whether a man sells dates from his land and exempts one (or some) kurr, he replied: It is astonishing that he knows the date palm tree (as to how many dates it will yield).

Hazrat Hajjaj says that I asked Hazrat Abu Bakr bin Abu Musa, may Allah have mercy on him, that a man sold goods to another and he said, "I am your partner in the goods?" He disliked this sale.

Hazrat Salim disliked that in a sale, some nails, a heap, or specific utensils be excluded.
