Hadith 22413
٢٢٤١٣ - حدثنا أبو بكر قال: حدثنا أبو خالد الأحمر عن أشعث عن الحكم في الرجل يشتري الجارية فيقول البائع: لا أدفعها إليك حتى تحيض، فوضعت على يدي عدل فماتت، فقال: هي (من) (١) مال البائع.
It is narrated from Hazrat Hakam (may Allah have mercy on him) that if a person buys a slave-girl and the seller says, "I will not hand her over to you until she menstruates," and she is entrusted to a just and trustworthy person and then she dies, Hazrat Hakam (may Allah have mercy on him) said: "She has perished from the seller's property." (The loss will be counted against the seller.)
Hadith 22414
٢٢٤١٤ - حدثنا أبو بكر قال: حدثنا محمد بن فضيل عن زكريا عن عامر أنه سئل عن رجل اشترى جارية فزعم أنها حبلى، فأنكر الذي باعها فوضعوا الجارية على يدي عدل حتى (يبين) (١) حملها فماتت، فقال: إن كان (تبين حملها فهي من مال البائع وإن) (٢)، لم (يكن تبين) (٣) حملها فهي من مال المشتري.
Hazrat Aamir, may Allah have mercy on him, was asked about a person who bought a slave-girl and thought that she was pregnant, while the seller denied it. The slave-girl was entrusted to a just person until her pregnancy became apparent. If she died, what is the ruling? He, may Allah have mercy on him, replied: If her pregnancy becomes apparent, then her loss will be from the seller’s property, and if the pregnancy does not become apparent, then her loss will be from the buyer’s property.
Hadith 22415
٢٢٤١٥ - حدثنا أبو بكر (قال: حدثنا وكيع) (١) عن إسرائيل عن جابر عن عامر والحكم في رجل باع (من رجل) (٢) جارية فظفر بعيب، (فوضعاها) (٣) على يدي (عدل) (٤) فماتت، قالا: هي من مال البائع.
Hazrat Aamir and Hazrat Hakam, may Allah have mercy on them, were asked: A person bought a slave-girl and defects were found in her, and she was entrusted to a just person, then that slave-girl died. What is the ruling in this case? Both replied: She will be considered destroyed in the seller's property.
