Hadith 22351
٢٢٣٥١ - حدثنا أبو بكر قال: حدثنا سفيان بن عيينة عن أيوب بن موسى (عن) (١) ابن (قسيط) (٢) عن سليمان بن يسار أن أمة أتت قومًا فغرتهم (وزعمت) (٣) أنها حرة، فتزوجها رجل فولدت منه أولادًا فوجدوها أمة، فقضى عمر بقيمة أولادها في كل مغرور (غرة) (٤) (٥).
It is narrated from Hazrat Sulaiman bin Yasar, may Allah have mercy on him, that a slave woman (after migrating) came to a certain people and deceived them, telling them that she was free. A man married her and had some children with her. Later it became known that she was actually a slave woman. So Hazrat Umar, may Allah be pleased with him, decided that the value of her children should be paid, stating that every person who is deceived in this way should be compensated with a penalty of a slave (male or female).
Hadith 22352
٢٢٣٥٢ - حدثنا أبو بكر قال: حدثنا عبد الأعلى عن سعيد عن قتادة عن خلاس أن أمة أتت طيا فزعمت أنها حرة، (فتزوجها) (١) (رجل) (٢)، ثم إن سيدها ظهر عليها فقضى عثمان أنها وأولادَها لسيدها، وجعل لزوجها ما أدرك من (متاعه) (٣)، وجعل فيهم السنة أو الملة: في كل رأس رأسين (٤).
It is narrated from Hazrat Khallas (may Allah have mercy on him) that a slave girl came to the tribe of Tayy. She claimed that she was free, and considering her free, a man married her. Then the master of the slave girl came to take her back. Hazrat Uthman (may Allah be pleased with him) decided that the slave girl and her children would go to the master, and for her husband, he would have whatever he had gained from the belongings. Then he established among the people this practice that for every soul there are two souls.
Hadith 22353
٢٢٣٥٣ - حدثنا أبو بكر قال: حدثنا يزيد بن هارون عن أشعث عن الشعبي قال: سألته عن جارية أبقت (١) من أرض إلى أرض أخرى فأتت قومًا، فزعمت أنها ⦗٥١٧⦘ حرة، فرغب فيها رجل فتزوجها فولدت (له) (٢) أولادًا ثم علموا أنها أمة، فجاء مولاها فأخذها، قال: يأخذ المولى أمته، ويفدي الأبُ أولادهَ (بغرة) (٣) غرة.
Hazrat Sha’bi (may Allah have mercy on him) was asked: A slave girl ran away from one city to another city, and went to a certain people and presented herself as free. One man became interested in her, liked her, married her, and had some children with her. Later it was discovered that she was actually a slave girl and her master also arrived. Can the master take the slave girl away? He (may Allah have mercy on him) replied: The master will take his slave girl away, and for the father of her children, there will be a slave or slave girl (he will be given a slave or slave girl).
Hadith 22354
٢٢٣٥٤ - حدثنا أبو بكر قال: حدثنا الفضل بن دكين عن هشام بن (سعد) (١) عن شيبة بن نصاح عن سعيد بن المسيب قال: في (ولد كل) (٢) مغرورٍ غرةٌ.
Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) says that for every child born from a marriage conducted through deception, there is a ghurra (a slave man or woman) as compensation.
