Musannaf Ibn Abi Shaybah

Hazrat Ibn Buraidah (may Allah be pleased with him) narrates from his father that a woman came to the service of the Holy Prophet (peace and blessings be upon him) and said: I had given a slave woman in charity on behalf of my mother. My mother has passed away and the slave woman has remained with me. The Prophet (peace and blessings be upon him) said: Your reward has been completed and the slave woman has returned to you as inheritance.

It is narrated from Hazrat Humaid bin Hilal (may Allah have mercy on him) that a man gave his mother a slave girl as charity. His mother made that slave girl a mukataba (a slave with a contract for freedom), then she passed away, so the slave girl came back to him as inheritance. That man asked Hazrat Imran bin Husain (may Allah be pleased with him) about this matter. He (may Allah be pleased with him) said: "You will be the heir to your mother's estate, and if you wish to deal with her (the slave girl) as you did before, you may do so." Hazrat Humaid says that her name was Labeebah.

Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) says regarding a person who gives something in charity and then it returns to him as inheritance: He says that if it returns to him according to the command of the Book of Allah, then there is no harm in it.

Ibrahim (may Allah have mercy on him) said that if a person, after giving something in charity, becomes its owner again through inheritance, then he should do with it as he did before.

It is narrated in a similar manner from Ibrahim al-Taymi, may Allah have mercy on him.

Hazrat Shurayh (may Allah have mercy on him) did not consider it objectionable for it to be eaten.

Hasan (may Allah have mercy on him) did not consider there to be any harm in eating it.

Hazrat Sha'bi (may Allah have mercy on him) said: Eat it, Allah Almighty has not made its consumption unlawful for you.

Hazrat Masrooq (may Allah have mercy on him) says that whatever comes to you as a share in inheritance, eating it is lawful for you.

It is narrated from Ibrahim al-Taymi (may Allah have mercy on him) that whenever Umar (may Allah be pleased with him) gave something in charity, and if it returned to him as inheritance, he would treat it in the same manner as he did before.

Hazrat Ibn Abbas (may Allah be pleased with both of them) said: If it returns to you in inheritance, then there is no harm.

Hazrat Sha’bi (may Allah have mercy on him) says regarding the person who gives something in charity and then receives the same thing as inheritance, that his share in the inheritance will not add anything to it except permissibility.

Hazrat Ata (may Allah have mercy on him) says that if a person gives something in charity and then that same thing comes back to him as inheritance, he should assign it to the share of another heir.

Hazrat Muzarri (may Allah have mercy on him) says that I asked Hazrat Sha'bi (may Allah have mercy on him) about this matter. He (may Allah have mercy on him) replied: If you take your share, there is no harm; and if you leave it, that is better.

Ibrahim (may Allah have mercy on him) said that he will keep it in the same way (he will give it in charity again).

Hazrat Umar (may Allah be pleased with him) said that the she-camel given as a vow and charity are for that Day. (For the Day of Judgment).
