Musannaf Ibn Abi Shaybah

Hazrat Tariq bin Abdur Rahman (may Allah have mercy on him) narrates that I was present with Hazrat Shurayh (may Allah have mercy on him) when a person came and said, "I had a written agreement with this man, and besides him, there were two other men as well. Can I claim my right from whichever of them I wish?" That man said, "Both my companions are in the market." Hazrat Shurayh (may Allah have mercy on him) said, "You may claim your right from whichever one you wish."

Hazrat Ibn Jurayj (may Allah have mercy on him) says that I asked Hazrat Ata (may Allah have mercy on him) that, in trade, the names of two men have been registered.

Ibrahim (may Allah have mercy on him) was asked about a written agreement concerning some men: from whom can one take his full right? He replied: That depends on the condition (that was agreed upon); he may take his full right from whomever he wishes. And Ibrahim (may Allah have mercy on him) preferred that each person be taken from according to his share, and he used to say that this method is closer to justice.

Hazrat Hakam (may Allah have mercy on him) says regarding the person who has a right over a people, he says: All those from whom I can claim the full right, they are all considered as guarantors.

Hazrat Abu Juham (may Allah have mercy on him) says that I had written down my right over some people, specifying from whom I could fully collect my due. So I took them to Hazrat Shurayh (may Allah have mercy on him), and he said, "Collect from whomever you wish."
