Ruling if a Group of Slaves Is Made Mukatab and Some Die
Hadith 21763
٢١٧٦٣ - حدثنا أبو بكر قال: حدثنا جرير (عن) (١) منصور عن إبراهيم في النفر يكاتبون جميعا فيموت بعضهم قال: (يسعى) (٢) الباقون فيما كاتبوا عليه جميعًا.
Ibrahim was asked: If a group of slaves is made mukatab (contracted for manumission) and some of them die, what is the ruling? He replied: The remaining slaves should collectively try to fulfill the amount of the contract.
Hadith 21764
٢١٧٦٤ - حدثنا أبو بكر قال: حدثنا حفص بن غياث قال: سألت (عمرا) (١): ما كان الحسن يقول في الرجل كاتب مماليكه جميعا فيموت بعضهم؟ قال: يرفع عنهم بالحصة.
Hazrat Hafs bin Ghiyath narrates that I asked Hazrat Umar what was Hasan's opinion regarding if a group of slaves is made mukatab (contracted for freedom) and some of them die, then what is the ruling? He replied that their share will be forfeited.
Hadith 21765
٢١٧٦٥ - حدثنا أبو بكر قال: حدثنا وكيع عن (الأشعث) (١) عن الشعبي في رجل كاتب عبدين له فمات أحدهما قال: يرفع عنه بالحصة.
Hazrat Sha'bi says that a man made two of his slaves mukatab, and then one of them died, so his share will be forfeited.
Hadith 21766
٢١٧٦٦ - حدثنا أبو بكر قال: حدثنا الفضل بن دكين عن ابن أبي (غنية) (١) عن الحكم في الرجل يكاتب أهل البيت جميعا فيموت بعضهم، قال: يرفع (٢) بالحصة.
Hazrat Hakam was asked: If a group of slaves is made mukatab and some of them die, what is the ruling? He replied: Their share will be forfeited.
