Musannaf Ibn Abi Shaybah

Hazrat Sha'bi says that if a person buys something without seeing it, then after seeing it he has the option to either keep it or leave it.

It is also narrated similarly from Ibrahim.

From Ibrahim, it is narrated with the aforementioned content that after seeing, even if it is according to the agreed condition, there is still a choice.

Hasan says that if someone buys something without seeing it, then after seeing it, he has the choice (to keep or return it). Muhammad says that if it was according to the described characteristics, then now he cannot return it.

Ibn Sirin says that if the item turns out to be as per the agreed specification, then it cannot be returned.

Hazrat Mahmool, the freed slave of Aal Ammarah, says that I sold two sheets to a man and made a condition that if you open one sheet, the sale of both will become binding. He opened one sheet, then he was not satisfied with the sale and came back to return them to me. I refused to take them back and took this case to Qazi Shurayh. He said, "It is your consent, not his, whereas a sale is based on mutual consent."

It is narrated from Hazrat Mak'hool that the Prophet ﷺ said: When a person buys something in such a way that he has not seen it and the item is absent from him, then after seeing it, he has the choice to take it if he wishes, and if he wishes, he may leave it.

Hazrat Harith says that if a person buys a specific quantity of wheat and then the traders look towards each other, even then the sale will remain valid. However, if an apparent defect is found, it can be annulled.

Hazrat Sha’bah says that I asked Hazrat Hakam and Hazrat Hammad: If someone bought a slave from someone yesterday and now wants to sell him today without having seen him, can he do so? They replied that on the same day he bought him, he cannot sell without seeing him.
