Hadith 20331
٢٠٣٣١ - حدثنا أبو بكر قال: نا عبد الأعلى قال: سئل عن رجل قال لامرأته: إن لم أكن دفعت إليك كذاوكذا فأنت طالق ثلاثًا، قال: فحدثنا سعيد عن قتادة أنه قال: إن كانت له بينة، وإلا فقد بانت منه.
Hazrat Abdul A'la (may Allah have mercy on him) was asked about a man who said to his wife, "If I do not give you such-and-such wealth, then you are thrice divorced." What is the ruling regarding this? He replied that Hazrat Saeed (may Allah have mercy on him) narrates from Hazrat Qatadah (may Allah be pleased with him) that if the man has proof, then it is fine; otherwise, the woman will become separated (bainah) from him.
Hadith 20332
٢٠٣٣٢ - حدثنا أبو بكر قال: نا يعلى بن عبيد عن عبد الملك بن أبي سليمان عن عطاء في امرأة قال لها زوجها: إن لم أنفق عليك عشرة دراهم كل شهر فأنت طالق ثلاثًا، فقالت المرأة: قد مضت ثلاثة أشهر (لم تنفق عليّ شيئًا، قال: القول ما قال الرجل، إلا أن تقيم المرأة البينة أنه) (١) لم ينفق عليها.
Hazrat Ata (may Allah have mercy on him) says that if a man says to his wife, "If I do not spend ten dirhams on you every month, then you are thrice divorced," and the woman claims that he has not spent anything on her for three months, in this case, the man's statement will be considered valid. However, if the woman establishes testimony regarding the lack of expenditure, then her statement will be accepted.
Hadith 20333
٢٠٣٣٣ - حدثنا أبو بكر قال: نا هشيم عن أبي إسحاق الكوفي عن الشعبي في رجل قال لغريمه: إن لم (أقضك) (١) حقك قبل غروب الشمس فامرأته طالق قال: فلقيه من الغد، فزعم أنه لم يعطه شيئًا قال: فقالت له امرأته: (قد) (٢) طلقتني قال: فخاصمته إلى الشعبي، فقال الشعبي: أما امرأتك فنُديِّنُك (فيها) (٣)، وأما الرجل فبينتك (٤) أنك دفعت إليه ماله، وإلا فأعطه حقه.
Hazrat Sha’bi (may Allah have mercy on him) says that if a person said to his creditor, “If I do not pay your due before sunset, then my wife is divorced,” and then he met him the next day and said that he had not paid anything. His wife said to him, “You have divorced me.” Then she took this case to Hazrat Sha’bi (may Allah have mercy on him). Hazrat Sha’bi (may Allah have mercy on him) said, “As far as your wife is concerned, we leave that to your piety, and as for the man’s claim, you must bring evidence that you have paid his due, otherwise pay his due.”
