If a Man Swears That If He Speaks to His Brother, His Wife Is Divorced Three Times, What Is the Ruling?
Hadith 20326
٢٠٣٢٦ - حدثنا أبو بكر قال: نا يزيد بن هارون عن أبي العلاء وسعيد عن قتادة عن الحسن قال: (إذا) (١) قال (الرجل) (٢): إن كلم أخاه فامرأته طالق ثلاثًا، فإن شاء طلقها واحدة، ثم تركها حتى تنقضي عدتها، فإذا بانت كلم أخاه، ثم تزوجها إن شاء بعد.
Hazrat Hasan (may Allah be pleased with him) says that if a man said that if he spoke to his brother, his wife would be divorced three times. If he wishes, he may give her one divorce and then leave her until her waiting period passes, and when she becomes separated (bainah), he may speak to his brother. After that, if he wishes, he may marry her again.
