If a Man Divorces His Wife in Front of Two Men and One Woman, and One Male Witness Dies, What Is the Ruling?
Hadith 20325
٢٠٣٢٥ - حدثنا أبو بكر قال: نا عباد بن العوام عن زكريا عن الشعبي أنه سئل عن رجل (طلق امرأته) (١) عند رجلين وامرأة، (فشهد) (٢) أحد الرجلين والمرأة، وغاب الآخر قال: تُعزل عنه حتى يجيء الغائب.
Hazrat Sha'bi (may Allah have mercy on him) was asked: If a person divorces his wife in the presence of two men and one woman, and then one man and one woman testify while the other man is not present, what is the ruling? He replied: Until the absent person arrives, the wife will be kept separate from her husband.
