If a Man Dies and His Wife Is Pregnant, What Is the Ruling?
Hadith 20310
٢٠٣١٠ - حدثنا أبو بكر قال: نا هشيم عن سيار عن الشعبي في المتوفى عنها وهي حامل قال: يُنفق عليها من جميع المال حتى تضع، ثم يقسم الميراث.
Hazrat Sha'bi (may Allah have mercy on him) says that if the husband of a pregnant woman passes away, then she will be provided for from the entire wealth until the child is born, after which the inheritance will be distributed.
Hadith 20311
٢٠٣١١ - حدثنا أبو بكر قال: نا جرير عن مغيرة عن إبراهيم قال: إذا مات الرجل وامرأته حبلى لم يقسم الميراث حتى تضع.
Ibrahim (may Allah have mercy on him) said that when the husband of a pregnant woman passes away, the inheritance will not be distributed until the child is born.
Hadith 20312
٢٠٣١٢ - حدثنا أبو بكر قال: نا يزيد بن هارون عن جويبر عن الضحاك قال: يقسم ويترك نصيب ذكر، فإن كانت أنثى رد على الورثة، وإن كان ذكرًا كان له.
Hazrat Dhahhak (may Allah have mercy on him) says that if the husband of a pregnant woman passes away, the inheritance will be distributed, and the share of one son will be set aside. If a daughter is born, the remaining share will be distributed among the heirs, and if a son is born, he will receive it.
