If a Man Divorces a Woman with a Young Child, Who Gets Custody?
Hadith 20243
٢٠٢٤٣ - حدثنا أبو بكر قال: نا مروان بن معاوية عن عاصم عن عكرمة قال: (خاصم) (١) عمر أم عاصم في عاصم إلى أبي بكر، فقضى لها به ما لم يكبر أو (تتزوج) (٢)، فيختار (لنفسه) (٣) قال: هي أعطف وألطف وأرق و (أحنا) (٤) وأرحم (٥).
Hazrat Ikrimah (may Allah have mercy on him) narrates that Hazrat Umar (may Allah be pleased with him) brought the issue of the upbringing of Hazrat Asim before Hazrat Abu Bakr (may Allah be pleased with him), making Umm Asim a party to the case. He decided that the child would remain with Umm Asim until he reached maturity or until he got married. And he said that the mother is more kind, merciful, tender-hearted, and affectionate towards the child.
Hadith 20244
٢٠٢٤٤ - حدثنا أبو بكر قال: نا ابن عيينة عن يزيد بن يزيد (بن) (١) جابر عن إسماعيل بن (عبيد اللَّه) (٢) عن عبد الرحمن بن (غنم) (٣) قال: شهدت عمر خير صبيًا بين أبيه وأمه (٤).
Hazrat Abdur Rahman bin Ghanm (may Allah have mercy on him) narrates that Hazrat Umar (may Allah be pleased with him) gave the child the choice between the mother and the father.
Hadith 20245
٢٠٢٤٥ - حدثنا أبو بكر قال: نا ابن علية عن أيوب ويونس عن ابن سيرين عن ⦗٤٥٨⦘ شريح قال: الأب (أحق) (١)، و (الأم) (٢) أرفق.
Hazrat Shurayh (may Allah have mercy on him) said that the father is more deserving and the mother is more gentle.
Hadith 20246
٢٠٢٤٦ - حدثنا أبو بكر قال: نا أبو معاوية عن زياد (بن) (١) سعد أو (حدثت) (٢) عنه عن هلال بن أبي ميمونة عن (أبيه) (٣) عن أبي هريرة أن رسول اللَّه ﷺ خير صبيًا بين أبويه (٤).
It is narrated from Hazrat Abu Hurairah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) gave the child the choice between the parents.
Hadith 20247
٢٠٢٤٧ - حدثنا أبو بكر قال: نا (١) ابن علية عن يونس عن الحسن قال: هي أحق بولدها وإن تزوجت.
Hasan says: A woman has more right to the child, even if she gets married.
Hadith 20248
٢٠٢٤٨ - حدثنا أبو بكر قال: نا يعلى بن عبيد عن عبيدة عن إبراهيم قال: إذا طلق الرجل امرأته فهي أحق بولدها ما لم (تتزوج) (١) أو تخرج به من الأرض.
Ibrahim (may Allah have mercy on him) said that when a man divorces his wife, the woman has more right to the child until she gets married or until she wants to leave the area.
Hadith 20249
٢٠٢٤٩ - حدثنا أبو بكر قال: نا (عبيد اللَّه) (١) عن إسرائيل عن جابر عن عامر عن مسروق أنه خير صبيا بين أبويه: أيهما يختار.
Hazrat Masrooq (may Allah have mercy on him) gave the child the choice regarding the parents.
Hadith 20250
٢٠٢٥٠ - حدثنا أبو بكر قال: نا وكيع عن علي بن مبارك عن يحيى (عن) (١) أبي ميمونة عن أبي هريرة قال: جاءت امرأة إلى رسول اللَّه ﷺ (قد) (٢) طلقها زوجها فأرادت أن تأخذ ولدها قال: فقال رسول اللَّه ﷺ: "استهَمِا فيه"، فقال الرجل: من يحول بيني وبين ابني؟ فقال رسول اللَّه ﷺ للابن: "اختر: أيهما شئت"، قال: فاختار أمه فذهبت به (٣).
Hazrat Abu Huraira (may Allah be pleased with him) narrates that a woman came to the Messenger of Allah (peace and blessings be upon him). Her husband had divorced her. The woman wanted to take her child. The Messenger of Allah (peace and blessings be upon him) said that the husband and wife should draw lots regarding the child. The man said, "Who can come between me and my child?" The Messenger of Allah (peace and blessings be upon him) said to the child, "Choose whomever you wish." The child chose his mother, and she took him and left.
Hadith 20251
٢٠٢٥١ - حدثنا أبو بكر قال: نا حفص عن (مجالد) (١) عن الشعبي أن أبا بكر ⦗٤٦٠⦘ قضى بعاصم بن عمر لأمه وقضى على عمر بالنفقة (٢).
Hazrat Sha'bi (may Allah have mercy on him) narrates that Hazrat Abu Hurairah (may Allah be pleased with him) gave the decision of Hazrat Asim bin Umar in favor of his mother, and the maintenance of the child was made obligatory upon Hazrat Umar (may Allah be pleased with him).
Hadith 20252
٢٠٢٥٢ - حدثنا أبو بكر قال: نا محمد بن بشر قال: نا سعيد بن أبي عروبة عن قتادة عن سعيد بن المسيب أن عمر بن الخطاب طلق (١) أم عاصم ثم (أتى) (٢) عليها و (٣) في حجرها عاصم، فأراد أن يأخذه منها، فتجاذباه بينهما حتى بكى الغلام، فانطلقا إلى أبي بكر، فقال له أبو بكر: يا عمر! مسحها وحجرها وريحها خير له منك حتى يشب الصبي فيختار (٤).
Hazrat Saeed bin Musayyib (may Allah have mercy on him) narrates that Hazrat Umar bin Khattab (may Allah be pleased with him) divorced Hazrat Umm Asim. Then he came to take Hazrat Asim from her lap. Both of them wanted to take the child, so the child started crying. Both went to Hazrat Abu Bakr (may Allah be pleased with him), so Hazrat Abu Bakr (may Allah be pleased with him) said to them that a mother's love, a mother's lap, and a mother's fragrance are better for the child than you. When the child grows up, he will choose for himself.
Hadith 20253
٢٠٢٥٣ - حدثنا أبو بكر قال: نا (١) ابن إدريس عن يحيى عن القاسم أن عمر بن الخطاب طلق جميلة بنت عاصم بن ثابت بن (أبي) (٢) (الأقلح) (٣) فتزوجت فجاء عمر فأخذ ابنه فأدركته (الشموس) (٤) ابنة (أبي عامر) (٥) الأنصارية وهي أم جميلة فأخذته فترافعا إلى أبي بكر، وهما متشبثان، فقال لعمر: خل (بينها) (٦) وبين ⦗٤٦١⦘ ابنها، (فأخذته) (٧) (٨).
Hazrat Qasim (may Allah have mercy on him) narrates that Hazrat Umar bin Khattab (may Allah be pleased with him) divorced his wife Hazrat Jameela bint Asim bin Thabit. Then Jameela bint Asim got married again. So Hazrat Umar (may Allah be pleased with him) came to take his son. Hazrat Jameela’s mother, Shamoos bint Abi Amir Ansariyyah, picked up the child, and both of them took the case to Hazrat Abu Bakr (may Allah be pleased with him). He said to Hazrat Umar (may Allah be pleased with him), “Do not come between the child and his mother.” Then she took the child and left.
